Job Description: The International Criminal Court (ICC) is seeking a qualified and competent Counsel to represent Mr. Joseph Kony during the confirmation of charges proceedings. The position involves providing legal representation and ensuring the protection of Mr. Kony’s rights and interests in accordance with the ICC’s legal framework.
Background:
The Pre-Trial Chamber II has issued a decision to hold a confirmation of charges hearing in the case against Mr. Joseph Kony in his absence. The hearing is scheduled to commence on 15th October 2024. In preparation for this, the ICC Registry is initiating the process of selecting counsel to represent Mr. Kony’s rights and interests.
Role of Counsel for the Defence:
- Lead a legal team and undertake all necessary work to represent Mr. Kony.
- Make court appearances and file written submissions.
- Object to charges, challenge evidence, and present evidence during the confirmation hearing.
Duration of Appointment:
The appointment of Defence counsel is expected to last for the duration of the confirmation proceedings, including potential appeals. The appointment will continue until the judgment on any potential appeal.
Remuneration:
Legal aid is available for individuals entitled to representation and with insufficient means to pay for it. The ICC will bear the cost of Mr. Kony’s defence in accordance with the Legal Aid Policy.
Minimum Requirements:
- Admittance to the List of Counsel maintained by the Registrar under ICC rules.
- Fluency in English or French.
- Established competence in international or criminal law and procedure.
- Minimum 10 years of relevant experience in criminal proceedings.
- Compliance with the ICC’s Code of Professional Conduct for counsel.
Selection Criteria:
- Expertise and experience in criminal trials and managing complex cases.
- Active registration with relevant controlling administrative authority.
- Experience before international tribunals or in cases involving international crimes.
- Full-time availability and readiness to commit significant time to proceedings.
- Minimum knowledge in information technology.
- Absence of impediments to representation and conflict of interests.
